Default Five ‘Stand Your Ground’ Cases You Should Know About

The Stand Your Ground law is most widely associated with the Feb. 26 shooting death of Trayvon Martin, an unarmed 17-year-old killed in Florida by George Zimmerman, a neighborhood watch captain who claimed he was acting in self-defense.

The 10 most infamous ‘Stand Your Ground’ cases The killing of Trayvon Martin by a self-appointed neighborhood watchman has brought the issue of “Stand Your Ground” laws, which started in Florida in 2005 and now are on the books in some form in 18 states.

But are these laws applied equally? Or does race, and gender, play a role in who gets immunity under Stand Your Ground, and who doesn’t?

Here are ten of the most infamous cases.

ProPublica and the Tampa Bay Times cite “nearly 200 instances since 2005” where the state’s Stand Your Ground law has played a factor in prosecutors’ decisions. Unfortunately, they do not cite thousands of documented stories of armed self-defense between 2003-2010 (TheArmedCitizen-DOT-com). These are tiresome arguments that have been conclusively answered by scholars like John Lott (MORE GUNS LESS CRIME, 1998).

One does not need to be a homicide detective to understand why conceal-carry (CCW) communities like Culver City endure a fraction of the violent crime endured by neighboring communities like Inglewood and South Los Angeles. For every questionable CCW shooting, thousands of crimes are averted not because someone carries a concealed weapon, but because criminals don’t know who does and does not. While Culver City (CA) typically suffers 2.5 homicides and 288 crimes per 100,000 in a given year, neighboring Inglewood typically suffers ten times as many (or more) in a given year. The difference isn’t the poverty, but that the politicians who control these cities don’t trust that their law-abiding tax-paying constituencies are responsible enough (or smart enough) to own and carry handguns.

When I worked a patrol car in South Los Angeles, my job would have been far easier if someone other than gangsters carried firearms.

None of us know the facts of the Martin case. But regardless of its merits, Zimmerman does not reflect on the millions of other US gun owners any more than Lindsey Lohan’s poor driving reflects on US car owners. The fact that liberals use cases like Travon Martin to push gun bans illustrates the weaknesses of their unconstitutional agenda.

Judge denies college student’s self-defense bid in killing of South Miami man

A former Miami Dade College student who stabbed a South Miami man to death lost his bid for immunity under Florida’s self-defense law.

A judge on Thursday ruled that James Arauz, 23, did not act in self-defense when he stabbed Vincent Pravata in October 2009. Arauz claimed that Pravata, who acted as a mentor and had penned a letter of recommendation for an internship, made sexual advances and chased him around the man’s house.

Anti-gun group study: In states with 'stand your ground' laws, justifiable homicide rates soar

By Rene Stutzman, Orlando Sentinel
6:15 p.m. EDT, September 16, 2013

A new study by a coalition of gun-control groups, including Mayors Against Illegal Guns, found that in states that have implemented "stand your ground" laws, the number of justifiable homicides has skyrocketed.

The rate is up 53 percent in 22 states, according to the study. In Florida, the average annual rate is up 200 percent. In states that do not have those laws, the rate has declined marginally.

The study, co-sponsored by the National Urban League and VoteVets.org, also concludes that the number of deaths of black people deemed to be justifiable in states with those laws has doubled.

"These laws can have deadly consequences, particularly for African-Americans," former New Orleans Mayor Marc Morial, president of the National Urban League, said in a prepared statement. "We need our elected officials to reform these policies to make sure we're doing the right things to reduce unjustified shootings and save lives."

The 28-page report was released one day before a congressional hearing on the issue, scheduled by the Senate Judiciary Subcommittee on the Constitution, Civil Rights and Human Rights.

Our family just does not understand how a man who proudly fought for his country, and spent 6 years proudly serving as a U.S Airman, could lose the right to live his life for defending himself. The fact is, Michael was attacked, and he was afraid the group fighting would kill him. He fired his legally registered weapon to gain the opportunity to run, from somewhere he had the legal right to be. His attacker not only attacked him but he admitted to attacking others that night.

This sentence has destroyed our family and we hope you will sign this petition to ask Governor Rick Scott and the Clemency Board to commute the sentence of Michael Giles.
Get the word out! Sign the petition, and let Governor Rick Scott of Florida know that Michael Giles MUST be set free.

Michael was an upstanding Airman, and dedicated father, who believed he was in the right to defend himself.

Governor Scott, are you suggesting that everyone but African Americans have the right to “Stand Their Ground” in the state of Florida? If so, we request that you just come out and say it. Sign it into law so that African Americans know where we stand.

Furthermore, we DEMAND that the Florida Clemency Board to waive the stipulation of Giles serving one-half of a minimum mandatory sentence and be immediately consider before the Clemency Board.
