Yes unfortunately.

But I still don't think it's going to help her chances of getting bail that her baby's father who is living with her has a criminal history which included at one time, charges of fleeing and evading police.

John Goodman was let out by the same Judge (not Kelly) who let her out and the Judge denied him bail a second time after he was convicted again.

I hope to God he sends her sorry ass to prison so she can start serving her sentence and she doesn't get to relax at home for another 8 years.

Dalia Dippolito to Serve Jail Time During Appeal in Murder-for-Hire Case

A Florida judge has ruled against Dalia Dippolito in her attempt to remain free as she appeals her conviction for plotting to have her husband Mike Dippolito killed in 2009. Dippolito was found guilty of solicitation to commit first-degree murder after arranging to pay someone to kill Mike, not realizing that the person she hired was an undercover officer. Making the story even more dramatic was that the arrest was caught on camera by the reality TV show “COPS.”

Dippolito was sentenced to 16 years in prison for her crime, but she is appealing the conviction. This was her third trial in this case. She successfully had a conviction in the first trial overturned, then the second trial ended in a hung jury, before she was convicted in the third trial. Dippolito’s attorneys tried to convince Judge Glenn Kelley to let her stay under house arrest for the duration of the appeals process.

Judge Kelley was not convinced, however, and at a Wednesday hearing, he denied Dippolito’s motion to remain out of prison, showing concern that she could try to flee, and calling some of her lawyers’ arguments “bordering on frivolous.”

Very interesting. During her first trial, I guess one of the potential jurors had heard of Dalia attempting to poison her husband and he/she was discussing it with the other potential jurors.

The judge counters Claypool's whining by pointing out that the appeals court ruled that they granted her a new trial because the evidence had been introduced improperly, not because it shouldn't have been introduced at all.

All in all, IMO, a really well written response.

I agree, it was a very well written response.
And bond was denied partially because she has a son and a boyfriend, flee risk.
And then the stupid jail house phone conversation she had with her boyfriend.

Dumb dumb woman.
Oh well, she is where she belongs.

Did you read in his order that defense had an expert (who examined Dalia) to testify that Dalia suffered from PTSD and that as a result, are you ready for this, as a result Dalia was "highly susceptible to coercion by men at the time of the incident." LMAO

State had the right to call for their own examination of Dalia. Long story short, they scheduled it, defense didn't show up, they re-scheduled it, and again defense didn't show up.

It starts on page 14 of his order, halfway down the page, under "Exclusion of Expert."

Try to keep a straight face while you read it.

I read it.... and can't believe that this defense and their shady ways.

Did you know, the State has filed a motion to try to get the defense to pay for their costs..... for the defense not showing up for the examine?

LOL I'm sure the defense will be mentioning that in their appeal too.

The judge was very well-tempered in his wording.

He said "frivolous" motions.

I would have said defense engaged in non-stop asshattery.

Yeah hearing her lawyer using her "infant son" as a bargaining chip to elicit sympathy during closing arguments to the jury was one of the more sickening parts of this.

The really bizarre part is I heard that Claypool was defending her pro bono. Is that true? He'd go that far to try to manipulate, cheat and lie his way to a Not Guilty verdict for someone who was caught on tape committing the crime they were charged with and who wasn't even paying him? What a POS. I mean he'd still be a POS if there was money involved, but this just makes it more so.

Oh well. I guess he'll have to find another alternative for his next booty call.
