Lawyers ask for new trial for Michael Dunn in 17-year-old's shooting death in dispute about loud music

"Simons’ expertise is in pathology, not accident reconstruction, and Circuit Judge Russell Healey should not have allowed Simons to testify about issues that she wasn’t an expert on, Roberts said.

The appellate judges appeared more open to this argument, with Judge Ross Bilbrey bringing the issue up and saying it was a concern of his.

The judges did not say when they would rule on the appeal. But most rulings occur a couple of months after oral arguments conclude."

Looks like the only issue they're concerned with is No. 4 listed in Sunny47's post above: 4. The judge improperly allowed the medical examiner to reconstruct the shooting of Davis. [more specific info at the link]

Whether the door was open or closed is an important issue on the self defense claim. The ME testified it was closed, negating Dunn's claim that Davis was advancing on him or alternatively appeared to be advancing.

Michael Dunn is/was a smart-azzed hot head who thought he could/would get away with murder. JMO

New documents obtained by Action News Jax reveal Michael Dunn is being housed in an Oregon prison.

The revelation is an update to an Action News Jax investigation that exposed how the State of Florida hides high-profile killers including Dunn and the man who murdered Somer Thompson.

He’s being housed thousands of miles away, in Salem, Oregon. The reason? For his own protection.

Action News Jax Law and Safety Expert Dale Carson says moving an inmate to another state is rare.

“The U.S. government allows states to enter into these compacts, and that is what happened to Mr. Dunn," Carson said.

According to Florida’s Department of Corrections, a little more than 3,000 inmates are part of the interstate prison compact.

In a letter to Action News Jax reporter Bridgette Matter, he talks a lot about the evidence, claiming “Math, science, and self defense law” and “simple geometry” should exonerate him.

Dunn has reopened his case, representing himself requesting a new trial and counsel. We showed the letter to Jordan Davis’ father Ron Davis.

"I felt like he was very unemotional. It was about the law, it was about his perception of the law," Davis said.

Five years later, Davis said the letter proves Dunn still has no remorse.

Dunn wrote, “The public and therefore the jury were not interested in facts, they were only interested in emotion, blame, anger and fear, not facts. Apparently, in a battle between science and spectacle, spectacle wins.”

He goes on to say, “The prosecution's false narrative is that I shot and killed this young man because I was angry with him for playing music loudly.”
