FOX13 Memphis @FOX13Memphis The judge admitted choosing a jury this early ahead of the July 10 trial isn't typical. But it was the date already set #HollyBobo

I wish that the judge had not allowed the defense to delay the start of this trial until July. It seems a bit unusual to have much of the jury selection handled so early on, they a delay until the trial actually gets underway with opening statements.

Wouldn't that delay give the defense a huge opportunity for mistrial claims?

Yes, I would think that it would give them a HUGE window to investigate the jurors.

Well this is really discouraging because I truly believe deep down in my heart that these repulsive creeps are responsible. I hope to God Tennessee has what it's gonna take to put them away.

Since the jury will be sequestered, the judge has indicated that they will work 5 1/2 days a week, 9 a.m. to maybe 5:30 p.m. ....off Saturday afternoons and Sundays. Final jury selection will happen July 6.

Opening statements are set for Monday, July 10.

Of note, it seems that sometime late in May 2017, the State has come up with a new piece of evidence, a GUN. That makes me wonder if that finding was the result of something that had to do with perhaps one of the defendants and a rumored plea bargain?

As a reminder the trial starts on July 10 - there was some talk of a plea deal today. Clearly not happened #hollybobo

Another aspect of the trial touched upon was that the state has given immunity agreements to five people in the case.

I'm still trying to keep the co-defendants' names straight. And, this judge and the attorneys seem to be trying to keep a lot of things from getting out to the media/public so far. The judge wouldn't even hear a lot of the motions yesterday, saying he'd take them up during a bench conference during the trial when he'd heard enough to be able to rule on them.

...I'm almost starting to wonder if this judge is the right judge to be presiding over these cases.

Two other men — John Dylan Adams and Jason Autry– were also charged with the woman’s murder.

All three pleaded not guilty.

However, in a motion discovered by WKRN back in March, Autry reportedly confessed to taking part in Bobo’s kidnapping, rape and murder in early 2017.

WTVF reports that they are still unsure if Dylan Adams will be a witness the case or not.
According to the judge, the state has made immunity agreements with five people.

It’s unclear if he received a plea deal, but the judge did confirm during the pre-trial hearing that at least five individuals had been given immunity.

The trial for Dylan Adams has not been scheduled.

Holly Bobo Trial Delayed Until September

9:40 AM, Jul 6, 2017
SAVANNAH, Tenn. - The Holly Bobo murder trial has been delayed until September after the state introduced new evidence in the case.
Zach Adam's trial was set to begin on July 10. However, the trial was delayed to September 11 after prosecutors surprised everyone last week by revealing they recently recovered a gun that would be introduced as evidence.
It was unclear if it was the murder weapon or if it could be linked to Adams.
The gun was apparently found underwater, but it’s unclear as to where it was located.
The defense said they want to test the mud, water and sediment to determine how long it had been there. However, they couldn't do it by Monday.

Jury selection was set to begin Thursday morning, but that date has been moved to September 9.
"I want to try this case professionally and correctly," Judge C. Creed McGinley said before telling jurors they were being sent home today.

OMG, I can't begin to imagine how the Bobo family must feel. I'm guessing that they have prepared themselves for this damn trial to start and now to have to wait another 2 months must be soul destroying.

5 witnesses granted immunity in Holly Bobo murder trial

Victor Dinsmore, Michael Alexander, Jason Kilzer, Shayne Austin, and Jason Wayne Autry were all granted immunity, according to court records filed in Hardin County.

The names were listed in notices of immunity filed in Hardin County in June which FOX13 reviewed Thursday.

According to court records, Autry was given Federal immunity. His attorney also arranged an agreement with prosecutors where Autry’s charges may be reduced after he testifies against Adams.

“The state does not have an immunity agreement with Mr. Autry,” Prosecutor Jennifer Nichols wrote in the Notice of Immunity. “The state and counsel for Mr. Autry agreed to discuss reduced charges against Mr. Autry after the trial against [Adams] and Mr. Autry’s truthful testimony.”

Austin, who was also granted immunity, was a person of interest in the case before he committed suicide in 2015.

During a court hearing in February, Nichols said Austin provided written testimony about Adams to the TBI before he killed himself.

“Do you recall Shayne Austin writing in his own hand writing that Zach said ‘I put her by the "T" in the river,’” Nichols read from a document in court in February, quoting Austin’s testimony about Zach.

“They’ll never find her there,” she continued, reading from the testimony.

The testimony is expected to be presented as evidence when Adams’ trial begins in September.

FOX13 reviewed a volume of court records Thursday related to Holly Bobo’s case.

The thick file revealed a snapshot of how prosecutors plan to prove Zach Adams’ role in Bobo’s murder.

Documents suggest phone records are also of interest. Multiple subpoenas required phone companies to provide records for various phone numbers.

According to the file, prosecutors are also interested in recorded conversations Adams’ had with friends and family while in jail.

Judge in Bobo case cited for gun incident at Memphis airport

Posted: Sep 07, 2017

Judge Creed McGinley was cited with a misdemeanor last Monday for bringing a gun into a restricted area of the airport.

The Holly Bobo murder trial is set to begin Monday. The Decatur County nursing student was murdered more than six years ago.

Thursday marked three years to the day that Bobo’s remains were found in the woods.

Bobo’s trial has been delayed twice already. Local attorney David Raybin said because this incident is a misdemeanor, it likely won’t affect the trial.

“In my opinion, there is certainly no reason for the judge to be excused from the case,” Raybin said. “He certainly has the right to recuse himself if he wishes, but there is no statutory procedure or requirement that he be removed from the case because of his citation and a misdemeanor offense. If this were a felony, certainly the answer would be much different.”

News 4 reached out to McGinley on Thursday night but was unable to get in touch with him.
