Excellent day at the Vista Courthouse ...

There were eight of us who sat on the side of the prosecution, all wearing CARR nametags. The judge, prosecutor and defense attorney's were well aware of our presence.

The prosecutor, Mark Coomba, (sp?) was on fire in presenting reasons why Raymundo Pura should be given 10 years for neglecting Frank Kiser to a point it caused his death.

(The judge did comment that during the trial, the photos of the victim were not only horrific, but Mr Kiser must have been in dire pain at the end of his life.)

Mr Pura told the probation department he was sorry Mr Kiser died, never admitting he was responsible. He blameshifted, accusing the prosecutor of creating a case without merit, (reminds me of: Dunn, GZ, JAR, DR). He is a 71 year old man attached to his cultural beliefs, (familly loyalty has a greater value than truth).

The probation department reccommended 15 years of prison time, (obviously none to happy with Mr Pura's refusal to accept responsibility).

Sentencing: No prison time, 4 years of probation, 40 hours of community service.

(Although Chris was disappointed RP was not given prison time I was not. Apparently he did not have enough money to hire two, "experts who would have proved," he was innocent.)

Alexander Pura was next, and did work a plea deal with the prosecutor. He did admit responsibility, (which enraged his father, RP, and he stated so in open court.) The charge against him was involuntary manslaughter.

Sentencing: 4 years of probation, 120 days work furlough

I did ask the prosecutor of judges are conscious of overcrowded prisons in CA, (we are under federal mandate to lower the prison population), and he said yes, it does factor into sentencing.

I did meet Hardy Gold, DA, and as he said the issues are ongoing, not enough funds. We will have a bill before the state legislature which would allocate funds for greater scrutiny of RCFE's this year, sorely needed.

“I am outraged and dismayed,” said Chris Murphy of Consumer Advocates for RCFE Reform, a San Diego nonprofit working to strengthen oversight of residential care facilities for the elderly.

Murphy said home operators won’t take responsibility for their actions if they know they are unlikely to be sent to prison.

I contacted KUSI, (known for puff pieces, with Michael Turko reporting on minor exsaperations of personal appeal), requesting more coverage on elder abuse issues, and no surprise, no reply to my email request.

If your loved one is a resident in assisted living, keep a close watch on that person, and the other residents in the facility for that matter. Watch for unexplained bruising, skin tears, decubitus ulcers and other tell-tale signs. And remember its not just physical abuse (slapping, hitting), psychological abuse (yelling, screaming), it is also NEGLECT. Neglect can manifest as bed sores on the back, buttocks, heels, elbows. Be especially watchful if your resident is bedridden or is a Total Care Waiver.

Earlier today I thought again of Frank Kiser, lying in bed covered in sores with, "trusted caretakers," and wondered, who was Frank Kiser. He lived to the age of 85, surely he contributed and had value to this world.

VISTA — An Encinitas dentist accused of stealing more than $260,000 from patients and using the money to buy high-end clothing and merchandise pleaded not guilty Thursday to 45 felony charges.

Dr. Edward Bodek, 60, and his wife, Mary, 56, are both accused of elder financial abuse, identity theft and conspiracy to commit fraud. If convicted, they could be sent to prison for more than 21 years.

San Diego Superior Court Judge Marshall Hockett raised Edward Bodek’s bail from $500,000 to $1.5 million, saying that he is a danger to the public and a flight risk.

Deputy District Attorney Anna Winn asked for the higher bail after telling the judge that a box of receipts had been found within the last couple of days containing the names of other patients who could be victims in this case.

So far, 24 victims have been identified, some of whom have been patients of Bodek’s for 20 years, the prosecutor said.

Deputy Public Defender Christine Yonan argued that the $1.5 million bail was “outrageous” given Bodek’s age and lack of a criminal record.

In August, Ravazzolo went to Dr. Bodek for a $67 teeth cleaning and ended up with $8,000 in unauthorized charges on his credit card, he said.

"I'm so disappointed in him as a person for doing this, and I can't understand why," said Ravazzolo.

When federal agents served search warrants on the dental office and on the Bodeks' apartment in Carlsbad, they found stacks of boxes and shopping bags, according to court records.

Agents also discovered 30 different storage units rented by the Bodeks, which were full of women's clothing, high end handbags, and fur coats with the price tags still on them, the records show.

Dr. Edward J. Bodek was interviewed at the time of his arrest, according to a probation report. “He admitted that he and his wife conducted the fraudulent/unauthorized credit card transactions on patient credit cards, but they intended to pay it all back,” the report stated.

However, “Dr. Bodek told friends that his wife was suffering from cancer and needed expensive treatment” and he obtained cash from some victims this way, investigators were told.

Both Bodeks admitted felony theft from their patients in a plea deal and got credit for time served. Edward Bodek was released August 21, and Mary Bodek is scheduled to be released from custody today, August 29, 2013, according to the San Diego County Sheriff’s website.

No jail time, other than being held prior to sentencing.

Legislation aimed at reforming California’s assisted-living industry pushed through separate committees at the state Capitol on Tuesday, making it more likely that rules governing senior homes will get tighter.

But the majority of testimony urged lawmakers to enact an overhaul that would, among other things, require homes to carry liability insurance, increase fines and inspections, protect whistle-blowers and require more timely investigations by regulators.

Other bills would raise the fee for a license to operate a home, require violation records to be posted online and boost training required to work inside an assisted living home or to serve as an administrator.

I'm pleased the books are finally going to be open to the public. An unfortunate fact is that docs routinely either pad a bill for services not performed, or bill using any code that will satisfy Medicare.

WASHINGTON (AP) — Medicare paid a tiny group of doctors $3 million or more apiece in 2012. One got nearly $21 million.
Those are among the findings of an Associated Press analysis of physician data released Wednesday by the Obama administration, part of a move to open the books on health care financing.
Topping Medicare's list was Florida ophthalmologist Salomon Melgen, whose relationship with Sen. Robert Menendez, D-N.J., made headlines last year after news broke that the lawmaker used the doctor's personal jet for trips to the Dominican Republic. Medicare paid Melgen $20.8 million.

I fired two docs who were treating my mother. Both for false billing, and I did report them to Medicare/VA.

As an aside, the, "Totanes Family of Grifters," have opened 3 more RCFE's in SD County ...

On Tuesday, 8 April, the Assembly Human Services (AHS) Committee (Stone, Chair) heard many bills under its purview, one of which was AB 1523 - requiring RCFEs to carry and maintain liability insurance as a condition of licensure. The bill, carried by Assembly Speaker-Elect Toni Atkins and Assembly Member Shirley Weber, and sponsored by CARR, was heard at 3pm.
Ms. Atkins addressed the committee, explained the need for RCFEs to carry liability insurance both as a best-practices for facilities, and a necessary tool to allow consumers to obtain accountability when adverse events occur to their loved ones. Chris Murphy, CARR's ED gave testimony also on behalf of the legislation, referring to two local wrongful death actions against two RCFEs. Faced with large judgments they were unable to pay, both facilities filed for bankruptcy protection; the state lost two facilities, and residents in each had to be relocated. Two additional testimonies on behalf of the bill were heard. Speaking in opposition to the bill was Denise Johnson, Consultant for the Community Residential Care Association of California. She expressed policy affordability issues for those facilities who care for SSI/SSP residents.

Radio icon Casey Kasem has gone missing, prompting a judge to order an immediate investigation into his whereabouts.

The order came Monday after a lawyer for Kasem’s wife said he’d been “removed” from the country without warning. Now his kids are counting down the days until his safe return.

“We're going to find him, take care of him and love him," daughter Kerri Kasem vowed in an exclusive interview with the Daily News. "He's going to be with family, not stuck in some unfamiliar place where he's dying alone."

Kerri Kasem is one of three adult kids from a previous marriage who have been battling stepmom Jean Kasem in court over access to their legendary dad.

Casey, 82, suffers from advanced Parkinson's disease, can no longer speak and is fed through a tube, sources told The News.

The "Top 40" legend had been living in a private care facility recently, but it's believed he was released at Jean Kasem’s request last week, Kerri Kasem said.

Los Angeles Superior Court Judge Daniel Murphy appointed Kerri Kasem as her dad's new temporary conservator. During the hearing, Marcus said he had "no idea" where Casey was.

UPDATE: 5/15/2014. AB 1523 received the full support of the Assembly today, with a vote of 77 ayes to 0 nays. The bill now moves on to the Senate's Human Services Committee. CARR will again be asking for letters of support to be sent to individual senate committee members. Please expect another email from CARR with the particulars to be included in the letter of support. And as before, the letters can be sent to CARR (we will take care of getting them to the appropriate senators) or they can be directly sent. But again, that information will be in our next email.

Casey Kasem has been found safe in Washington, law enforcement officials told ABC News, ending a frantic search for the missing radio DJ.

Sheriffs in Kitsap County, Washington, found Kasem, 82. Deputy Scott Wilson, the Sheriff's Office public information officer, said police found Kasem Wednesday at an address provided by California Adult Protective Services. His wife, Jean Kasem, was also there, Wilson said.

I consider Jean Kassem's behavior unacceptable and elder abuse. Apparently the court feels the same.

"Why is she trying to block a doctor from seeing my father?" Kerri Kasem asked in a statement Friday night, telling her stepmother, "If you truly love my father, you will do the right thing and allow him to get proper medical treatment."
Kerri Kasem's spokesman Danny Deraney said she has a special Washington state court order that allows her to see her father, but there was no timetable for when that will happen.
On Tuesday, Los Angeles Superior Court Judge Daniel S. Murphy ordered Jean Kasem to comply with court orders allowing doctors to evaluate her husband, and also allow his daughter Kerri to see him. He also ordered Jean Kasem to surrender her husband's passport and temporarily suspended her powers to determine her husband's medical care.

It would be a simple matter to have Casey Kasem's physician in attendance during an independently appointed doc's exam. As to his daughter, her visit with dad could be easily accomplished with several witnesses and a video recording.

Part of the proposed California RCFE Reform Act of 2014 deals with the lack of information available to consumers of assisted living services. (View CANHR's Statement of the Problem). AB 1571 (Eggman) seeks to amend the Health & Safety Code to require CA's Department of Social Services to, among other things, post online facility profile and compliance information by July 1, 2015.

Elders Face Abuse From Family Scammers

According to the most recent data available, there were about 3,500 confirmed cases of elder abuse in San Diego County in 2011, more than double than in 2009, according to the county Health and Human Services Agency’s department of Aging & Independence Services. The elderly are also particularly vulnerable to financial abuse, Greenwood said, by relatives, paid caregivers, identity thieves and scam artists.
In recognizing World Elder Abuse Awareness day today Greenwood focused on ways seniors can protect themselves from abuse.
• When hiring a caregiver, only go through a licensed and bonded agency, since there is no law in California mandating background checks for caregivers. “News flash,” Greenwood, said, “felons lie.”

This State Long-Term Services and Supports (LTSS) Scorecard is a multidimensional approach to measure state-level performance of LTSS systems that assist older people, adults with disabilities, and their family caregivers. This second edition of the State LTSS Scorecard measures LTSS system performance across five key dimensions: (1) affordability and access, (2) choice of setting and provider, (3) quality of life and quality of care, (4) support for family caregivers, and (5) effective transitions.
Performance varies tremendously across the states, with LTSS systems in leading states having markedly different characteristics than those in lagging states. LTSS performance is gradually improving, both nationally and in most states. Progress is notable in many areas where public policy has a direct impact, including performance of the Medicaid safety net and legal and system supports for family caregivers. But the pace of improvement must accelerate as the Baby Boom Generation moves toward advanced ages.

In a complaint letter to the Florida attorney general, Dunn alleges the company enrolled his grandmother “for the sake of billing the government for payment for their own financial gain.” The company misled the family about the purpose of hospice — emphasizing benefits such as at-home nursing care and free medications, without explaining that hospices don’t provide curative treatments, according to Dunn. Once enrolled, Dunn alleges, Vitas gave Maples a powerful cocktail of drugs against the family’s wishes, and repeatedly bumped her up to the most intrusive and expensive levels of care.
The final straw was the apparent confusion over Maples’ “full code” status. It’s a designation rarely seen in hospice, because it means the family wants the kind of life-saving treatment that hospices don’t provide.
When Dunn tried to cancel the service, he was ignored, he says.

Proceed with caution ...

My sister and I never saw bills from hospice. I did, however, have one problem with a nurse who questioned why I was often present when she was there. My reply, "I see my mother between 3-5 times per week." My thought, "What was her fear."

I've said this before and it's worth repeating, it's important to be aware and take appropriate action. I fired and reported two docs for overbilling Medicare and the VA.

Another incident that gets my blood boiled.


Horrifying home security video shows home aide HITTING an elderly woman because she fed her dog 'human food'

The video shows her hitting the woman over and over. Cursing at her and telling her to get the F**k up while she's hitting her.


Home health aide, identified as Brenda Floyd, is now a fugitive wanted on a charge of assault with bodily injury on the elderly/disabled
